A petition has been filed before the Bombay High Court against the central Government seeking a direction from the Court to file criminal complaint for tampering of status of Petitioner’s GST TRAN-1 Form online against Goods and Services Tax Network (GSTN) and non-resolution of grievance of the Petitioner by the Respondents.
Advocate R S Sharma submitted that record is not secured in hands of Pvt Company and asked the Government to takeover GSTN urgently. Petitioner has asked that CEO of GSTN may be directed to remain present in Bombay and should not be allowed to leave till all pending returns are filed in his presence. Petitioner has asked that interest penalty and late fees for delayed set off of GST should be compensated by GSTN. They further asked for high level enquiry through independent IT Experts against GSTN for tampering of status of GST TRAN-1 filed by the Petitioner and directed to submit report of enquiry before Hon’ble High Court.
They claimed that GSTN is being mismanaged and has not opened single Facilitation Centre in Bombay to resolve filing issues and Commissioners of GST are helpless in resolving issues after several communications.
They also pleaded the Court to direct the Government to urgently resolve technical issue in filing of GSTR 3B returns for the month of July 2017 onward till date and filing of returns should be allowed without payment of interest and late fees.
